WIPO Advanced Workshop on Domain Name Dispute Resolution: Update on Practices and Precedents

WIPO, Geneva, Switzerland, Tuesday and Wednesday, October 19 and 20, 2010 Overview The WIPO Arbitration and Mediation Center is internationally recognized as the leading institution in the resolution of Internet domain name disputes. Since December 1999, the Center has administered over 32,000 proceedings, of which over 17,000 under the WIPO-initiated Uniform Domain Name Dispute Resolution Policy (UDRP) adopted by ICANN. The UDRP applies to disputes in the generic top-level domains (gTLDs) (e.g., .com, .net, .org, .mobi), as well as an increasing number of ccTLDs.

Domain Owner Caught Fabricating Response in UDRP

Respondent says he met actor in 1999 – 28 years after the actor’s death. When I first saw the domain name Texican.com was in dispute, I thought the domain owner would win. After all, there are plenty of companies and entities that use the name “Texican”, so why should one complainant get the domain unless it was clearly targeted (not that that hasn’t happened before).

National Arbitration Forum Domain Name Dispute Filings Hold Steady in 2009

The National Arbitration Forum, an international provider of dispute resolution services, today announced a total of 1,759 cases were filed in its domain name dispute resolution program in 2009, compared to 1,770 cases in 2008. The following data pertains to the National Arbitration Forum domain name dispute resolution program in 2009 (January 1 to December 31, 2009):    Panelists heard and decided 1,333 of the 1,759 cases filed; parties worked together to settle many of the remaining cases.

.NL Dispute Resolution System Now Entirely Electronic

SIDN has modified the Dispute Resolution Regulations for .NL domain names as of 4 March 2010. As a result of the changes, much of the correspondence that previously went by post will in future go by email. For example, an initial complaint will have to be submitted to the WIPO Arbitration and Mediation Center in Geneva (WIPO) by email only.

ICANN: DNGLOBE LLC Loses ICANN Accreditation

ICANN terminated its accreditation agreement with registrar DNGLOBE LLC for failure to comply with the requirements of the Registrar Accreditation Agreement (RAA), the contract between ICANN and registrars that governs the registration of domain names under generic top-level domains such as dot-com and dot-org. The termination letter has been sent to DNGLOBE outlining the decision and reasons behind the decision: icann.org/correspondence/pritz-to-smirnoff-05feb10-en.pdf [PDF, 1,850K] To protect registrants, ICANN has initiated a process to identify a qualified and accredited registrar to take over management of the domain names formerly managed by DNGLOBE LLC through a bulk transfer. Guidance is provided below for registrants who may be affected by this action
