A series of six papers from the European Commission “represent a wholesale effort to put governments in charge of the internet” writes Kieren McCarthy. “They would be put in a position to decide how the internet’s underlying naming structure - the domain name system - expands and evolves. “If the DNS evolves in the right way of course, governments won’t need to do anything, they will let others get on with it. But just in case people decide to do something that isn’t in the public’s interest, then governments will be there to firmly but politely inform them that they are not allowed to do that. Well, that’s the theory anyway.” To read McCarthy’s analysis of the papers and the players and what is going on, check out his posting on his Dot NXT site at news.dot-nxt.com/2011/08/31/ec-papers-analysis .

As of 22 August, the WIPO Arbitration and Mediation Center commenced providing .domain name dispute resolution services for both QA and قطر. (Qatar) in accordance with the Qatar Domains Registry Domain Name Dispute Resolution Policy (“Policy”) and Rules for Qatar Domains Registry Domain Name Dispute Resolution Policy (“ Rules ”), and WIPO Supplemental Rules for Qatar Domains Registry Domain Name Dispute Resolution Policy (“Supplemental Rules”). Qatar Domains Registry provides for registration of domain names which utilize the two-letter country code in Latin characters, i.e., .QA, as well as the قطر. IDN ccTLD in Arabic script. قطر. results from ICANN’s IDN ccTLD Fast Track Process which was designed to introduce into the Domain Name System Internet extensions (top-level domains) corresponding to a meaningful representation of a country or territory name in non-Latin (or non-ASCII) script. The Policy, Rules and Supplemental Rules are applicable to disputed domain name registrations within both the Latin script (.QA) and Arabic script IDN (قطر.) ccTLD spaces. The Policy, Rules and Supplemental Rules for .QA and قطر. also feature upgrades based on the WIPO-proposed paperless Uniform Domain Name Dispute Resolution Policy (UDRP) model, the latter in effect at WIPO since December 2009. This includes paperless filings by parties while retaining the safeguard of hardcopy notification by the WIPO Center. In addition to .QA and قطر. (Qatar), the Center also provides domain name dispute resolution services for both .AE and امارات. (United Arab Emirates).

The domain name topping the chart was sadara.com, sold for $71,000 through Sedo. It was a quiet week for big sales with the second biggest sale being nursepractitioner.com, selling for $36,300. Overall there were 12 .COM sales in the top 20 while Sedo also accounted 12 of the top 20 sales. There were also five ccTLD sales in the top 20.
A cybersquatter has registered a domain name for a charity Amy Winehouse’s father intended to set up in memory of his late daughter. Mitch Winehouse is planning to set up a foundation to help young people suffering from drug abuse, a problem his daughter had, and has already received donations from the public. However Martin McCann bought the domain name amywinehousefoundation.com, hours after Mr Winehouse revealed his plans The Sun reports , and two weeks after Ms Winehouse died on 23 July. McCann also paid £160 to register the Amy Winehouse Foundation Ltd with Companies House on 2 August, The Sun further reported, despite having never met her or Mitch. “I’m not exploiting anything yet,” McCann told The Sun. “I’ve just bought some domain names. Anybody could have. It only takes the click of a mouse. I’m not ashamed or embarrassed. Detach yourself from emotions and think business.” “He is making every effort to hijack this charity to satiate his own needs for the charity. She’s not the only Amy Winehouse in the world.” McCann said he was approached by his internet service provider and asked to hand over the domain name. He added that he wants to “come to an arrangement” with Mitch - but only if he apologises for insulting him on Twitter. McCann, of Uxbridge, West London, said: “I’m not the d***head. The d***head is sitting over there without the name in his possession.”

The Rapid Evaluation Service, as it is known, is basically a souped-up version of the familiar UDRP that tilts the overall balance in favour of legitimate trademark holders, the report says. Further, the scheme is designed for companies or individuals who don’t want to be associated with .xxx domain names, and has the remedies to match.
Reliability, stability, trustworthiness are three of the most important features of a TLD, and one of the main messages that auDA, the policy and regulatory body for .AU, has been striving to convey writes Chris Disspain, auDA CEO and these days also ICANN board member. “In fact, I’m pretty sure we have been banging on about the importance of trust ever since auDA was established and assumed responsibility for the operation of .AU,” writes Disspain. “The relevance of this message has been highlighted by recent developments that have negatively affected thousands of British companies” where there have been “legal and administrative battles surrounding the operation of ‘gb.com’, which offers third-level registrations as an alternative to .co.uk.” With the downtime that ensued from the .gb.com outage, Disspain writes “what the recent events surrounding gb.com do highlight is the types of added risks registrants expose themselves to by choosing to register in a space that is selling third level domains on a commercial basis as opposed to in a well-regulated domain with well-defined policy frameworks.” Another third level domain to launch as an alternative to the country code in recent days is com.de, promoted as an alternative to .DE. .DE and .UK are the two largest ccTLDs. A problem that can arise is if the business selling the third level domains goes out of business - you lose your domain name. “All of the marketing and promotional efforts you have made go down the drain and your business may follow soon after.” “In contrast, registrants in a regulated space such as .com.au are afforded certain protections in the unlikely event of registrar failure and can recover their name and livelihood with the assistance of auDA and whichever registrar they choose to switch to. “Also, .AU has mechanisms built-in to deal with circumstances where you might find your business, trademark or other intellectual property rights infringed upon by a com.au registrant.” Disspain then writes that “another advantage of operating your business in a well-run domain is that doing so can resolve issues of confusion and trust for your most important stakeholders - your customers.” In conclusion Disspain writes, “all of these arguments tie back to one main issue - and the main motivation for this post - the importance of trust. Trust in the domain space you register in, trust in the security and stability of your commercial investment, and the trust your customers will have in your operations and the protection of their rights. All of these are vital drivers of success in the bricks-and-mortar world of business - and just as important online.” To read this full article by Chris Disspain, auDA CEO and as of June 2011 ICANN board member, go to: blog.auda.org.au/2011/08/09/without-trust-there-is-nothing/

[news release] RIGHT OF THE DOT, a domain name strategy consulting group for new generic top-level domain (gTLD) applicants and existing TLDs, announced today that it has entered into a cooperative arrangement with Architelos, a consulting and managed services company serving the same market. Under the arrangement, Architelos will refer gTLD applicants seeking premium domain name consulting services to RIGHT OF THE DOT, and RIGHT OF THE DOT will refer to Architelos clients looking for new TLD feasibility, financial modeling and TLD application services, as well as a managed solution for running the front office functions of a TLD registry. The internet name space is expected to expand into potentially hundreds of new TLDs, as companies are permitted to apply for generic names and even their own brand name in the form of a TLD, to generate greater brand awareness and control. However, achieving the benefits requires a comprehensive set of strategic services leveraging the best of several providers. The cooperative agreement between the two companies provides a complementary set of services targeted at generics and brand applicants. RIGHT OF THE DOT specializes in new and existing gTLD strategy, board advisement, premium domain strategy, market positioning and sales. The company is offering its expertise to assist new gTLD applicants in developing and executing premium domain name strategies including financial planning. Architelos’ executives have run registries and launched new TLDs. They provide the rigorous analysis and creative ideas for helping brands and businesses intelligently identify opportunities within the TLD industry. The company has also pioneered tools such as the Business Case Builder, which enables an applicant to easily create the cost and revenue projections for its TLD, as well as the customized report required by ICANN as part of the TLD application. “The Right of the Dot team is a great complement to the Architelos team in terms of industry experience and track record,” said Alexa Raad, CEO of Architelos. “Architelos is unique in what it offers our clients—a hands-on team of executives with a successful track record of building registries and launching TLDs and its Business Case Builder that helps brands and generic TLDs create a strong and defensible application for their desired TLD,” said Michael H. Berkens, Managing Director for RIGHT OF THE DOT. “Interest in new gTLDs continues to increase among entrepreneurs, investors and corporations. And rightly so,” said Monte Cahn, President of RIGHT OF THE DOT. “We are on the verge of a true paradigm shift in the domain industry, and forward-thinking businesses are aggressively planning around new gTLDs. With Architelos and RIGHT OF THE DOT in your court, you’ll have the business intelligence, valuation and sales support you need to ensure your next move is a success.” About Right Of the Dot LLC RIGHT OF THE DOT is an Internet consulting and advisement firm specializing in new and existing TLD strategy, board advisement, premium domain and market positioning, sales and services. The venture is the brainchild of two successful domain and Internet industry veterans, Monte Cahn and Michael H. Berkens, Esq., who possess a unique combination of vision, leadership and domain expertise. Cahn was the original founder of Moniker.com, a top 7 ICANN Accredited Registrar, who went on to head the Aftermarket and Sales Division of Oversee.net. Among other pioneering services, Cahn introduced the concept of Live Domain Auctions to the industry. Berkens, a domain investor with more than 75,000 domains, owns WorldwideMedia Inc., including the retail site MostWantedDomains.com. He founded and contributes to the widely read blog, TheDomains.com. Both principals of RIGHT OF THE DOT are members of the prestigious Domain Hall Of Fame, and are two of only 10 members. This highly qualified consulting group gives you access to the most experienced domain sales and marketing strategists in the industry. They are the only domain industry firm specializing in the many of the critical service offerings required to be successful in the ever-expanding domain industry. About Architelos Architelos, Inc. provides consulting and managed services for clients in the internet and domain name industry. The TMS service provides outsourced professional services and SaaS-based registry “front-office” solutions for both new TLD contract winners and existing small registries.
After a quiet week for big sales, the week to 12 June popped up with a good six-figure sale. Adventure.com topped the Domain Name Journal weekly sales chart, selling for an adventurous $200,000 through MediaOptions. It easily topped the second-biggest sale, phrases.com, which sold for $80,000 through UpMarketDNS followed by AdNet.com, selling for $60,000 through AfternicDLS/Moniker/SnapNames. Overall .COM names dominated the week with 16 of the top 23 (there was a three-way tie for 20th spot) while Sedo was a little quiet with the top sales leaderboard, accounting for 12 of the sales. There were also five ccTLD sales – three .CO domains, one .LY and one .DE.
Facebook has filed a suit against 25 typosquatter who have registered domain names similar to facebook.com reports VentureBeat . According to the report, the domain names in question are either typos or closely related to facebook.com and are what Facebook calls example of trademark infringement. “(The) defendants’ schemes also diminish the goodwill associated with Facebook and its marks, injure Facebook’s reputation, breach enforceable agreements between Defendants and Facebook, interfere with Facebook’s business, and unjustly enrich Defendants,” Facebook states in the court document. “Facebook therefore seeks an order cancelling Defendants’ rights in their typosquatter domain names or transferring those typosquatter domain names to Facebook, awarding Facebook damages and providing other relief.” Of those accused of typosquatting most are companies, a few individuals, and some of the domain names in question are facebobk.com, facemook.com, wwwfacefook.com, ffacebook.com and faecbook.com.
