French Domain Name Law Considered Unconstitutional by Constitutional Court

The French Constitutional Court has declared that article L.45 of the French Electronic Communications Act, the legal framework for domain name management under .FR, is unconstitutional however it ordered that the current rules remain in place until 1 July 2011. The order was given on 6 October to AFNIC, the registry for .FR, by the French Constitutional Court who considered unconstitutional article L.45 of the French Electronic Communications Act. The order from the court includes provisions that mean past decisions and any decisions made up until 1 July cannot be challenged on the basis of its decision.

IDG News Service – Dell on Friday refuted accusations that it was withholding evidence in connection with a long-running case charging the PC maker of willingly selling faulty PCs. Web hosting service provider Advanced Internet Technologies Thursday filed a motion accusing Dell of withholding evidence and failing to produce documents in its possession, according to a court filing. Australian Registrar Bottle Domains Termination By auDA Confirmed By Court

auDA, the.AU policy and regulatory body, has terminated the registrar accreditation of Australian Style Pty Ltd, who trades as Bottle Domains, following a the Court of Appeal of the Supreme Court of Victoria dismissing Bottle Domains’ appeal in proceedings against auDA on 23 July 2010. The termination came about following a serious breach of its obligations under the Registrar Agreement by Bottle Domains. In February 2009, auDA was notified by the Australian Federal Police that there had been a security incident which affected customers of Bottle Domains

German Court Orders Web Host to Disconnect The Pirate Bay – Digital Media Wire

Hamburg, Germany – A German court has granted a preliminary injunction against the current Germany-based Web hosts of file-sharing hub The Pirate Bay, TorrentFreak reported. Studio lobby group the Motion Picture Association petitioned a court in Hamburg for an injunction against CB3ROB Ltd, operators of the CyberBunker Web hosting service.

from the not-good dept Last year, we wrote about a troubling ruling against a web hosting firm, Akanoc, that was sued by Louis Vuitton for hosting some sites offering up counterfeit goods. We had trouble with the idea that a web host should be liable for what its users were doing, but some of the details that came out in the comment suggested that the hosting firm may have brought it upon itself by not responding to various takedown notices.
